Being a victim of domestic violence is traumatic and often terrifying, especially when your abuser continues to stalk, threaten, or harass you after you’ve left. In these dangerous situations, a restraining order can be a powerful line of defense, allowing you to call the police before your abuser actually harms you. To shield victims in a variety of circumstances, many states offer several different protective orders, with different processes and requirements. Here is an explanation of the types of orders available in Kentucky.

3 Common Types of Protective Orders

1. Temporary Protective Orders

In domestic violence cases, the court may issue an emergency protective order (EPO) without a hearing, placing immediate restrictions on the abuser’s actions. These short-term orders are used when the abuser and victim are family members, an unmarried couple who have a child together, or have lived together in the past. Generally, an EPO is in effect until the court can hold a hearing, which usually takes place within 14 days.

2. Domestic Violence Order

The exact provisions of the order may vary according to the circumstances of your case. For instance, the judge may order the offender to stop contacting you, cease making threats of violence, or avoid certain areas.

3. Interpersonal Protective Orders

If you’re not in a domestic relationship with your abuser but are involved romantically, you may petition the court for an interpersonal protective order (IPO). You may also apply for an IPO if the allegations involve stalking behavior or you’ve been a victim of sexual assault.
