What is a Chapter 7 and how does it work?

A chapter 7 is that part of the bankruptcy law that allows you to receive a fresh start wherein all your unsecured debt is dischaged.

What is a discharge?

A Court Order relieveing you of all your dischargeable debt and ordering creditors not to attempt to contact you any longer.

How does a person obtain a Chapter 7 Discharge?

By filing the proper petition with the bankruptcy Court and following up in the manner authorized by law with the Court.

Who is permitted to file a Chapter 7?

Any person who resides in or does business in the United States and if that person passes the so called means test and their budget is such that they qualify.

What is means testing?

An evaluation, based on the number of people in your household, that determines if you qualify by being under the median annual income for your state or you are otherwise allowed to file based on your disposable income.
