Many homeowners have furry family members who are trained to act accordingly when they’re introduced to new people. However, there may be an instance when a dog feels the urge to defend themselves or their owners. If you sustained a dog bite from a defensive canine, you may be entitled to compensation for the damages. Whether you have grounds for your own personal injury claim will depend on the following factors.

Relevant State Laws

When it comes to dog bites, some states follow a strict liability rule, while others have a one bite statute. Under the strict liability system, pet owners are responsible for any damages their dog cause regardless of whether they were negligent. For example, they would be liable even if the dog had never exhibited aggressive tendencies and they had still taken reasonable measures to contain it. Because Maryland implements this rule, most people who sustain a  dog bite can hold the owner liable in most scenarios.

In states that follow a one bite rule, on the other hand, pet owners are not liable for dog bites unless they knew—or should have known—the animal had aggressive tendencies and they failed to take reasonable measures to prevent additional injuries. That means in order for claimants to win the case, they must prove the owner knew the dog was likely to bite them.

The Circumstances of the Attack

personal injuryIf a dog is unleashed in a public space and ends up biting someone, the owner will almost always be liable. If the attack happens on the owner’s property, however, there are scenarios in which he or she is not responsible. In Maryland, for example, pet owners are not liable for bites that occur on their property if the person who sustained the dog bite was trespassing, committing a crime on the premises, or tormenting the dog in some way.  Hopefully you never have to deal with a dog bite, but in case you do it may be best to consult with an attorney.
