You might use Uber as a quick and convenient way of getting around town without driving yourself. But what happens if your driver is involved in an accident and you suffer a personal injury? Here’s what you should know to protect your rights and recover any damages.

Points to Remember if You Suffer a Personal Injury in an Uber Car

1. Uber Carries Liability Insurance for Its Drivers

Uber’s website states that it maintains automobile liability insurance for all of its U.S. drivers. If your driver is logged into the company’s app, then Uber covers any crashes. Ohio law requires motor vehicles to carry minimum commercial coverage of $25,000 for property damage, $50,000 per person for personal injury, and $100,000 per collision. Uber and other rideshare companies must carry total liability insurance of $1 million.

2. Uber Drivers Must Have Insurance

personal injuryIn addition to the Uber insurance coverage, Ohio requires Uber drivers to carry personal auto insurance. But if your driver is using their personal vehicle for Uber X service, your driver’s insurance company won’t pay your claim unless the driver’s insurance covers ridesharing, which is rare.

3. You Might Recover From the Other Driver

If another driver is at fault in colliding with your Uber driver, you can claim against the at-fault driver’s insurance company. But, if the at-fault driver doesn’t have insurance, you can file your personal injury claim with Uber.

4. Your Insurance Coverage Might Apply

If you have auto insurance, you should check your insurance policy for coverage. Your uninsured motorist or substitute vehicle coverage might apply to give you additional benefits.
