The first rule of safely operating a motorcycle is that you should wear a helmet whenever the bike is in motion. However, not every motorcyclist abides by that rule. If you’re injured in a motorcycle accident and you weren’t wearing a helmet, that could have implications for your legal standing, and for any right you have to seek compensation. Here is a brief rundown of Connecticut helmet laws, as well some factors that could impact your legal case. Speak with an injury attorney if you believe you’re entitled to compensation.

What Happens if You’re in a Motorcycle Accident Without a Helmet?

What the Law Says

injury attorneyWhile Connecticut does have laws governing the use of motorcycle helmets, these laws aren’t universal. Instead, they apply only to those who are under 18. Legal minors are not permitted to operate or ride on a motorcycle without wearing a helmet. For those 18 and older, however, the use of a helmet is not mandated by the law.

When You’re Not Injured in the Head

Helmets may not be required by law, but they can still have a bearing on your case—though this depends on the nature of your injury. If your injuries don’t include any wounds or trauma to the head, then the helmet doesn’t matter; for example, if you file a claim over a broken leg, it doesn’t matter whether you were wearing a helmet or not.

When You Are Injured in the Head

If you sustain a head injury and you were not wearing a helmet, however, that can complicate your claim for compensation. Even though Connecticut’s laws do not require a helmet, failure to wear one can be seen as comparative negligence. In other words, you did not do everything in your power to minimize injury, and thus assume some of the responsibility for it. Your injury attorney can explain this in greater detail as it pertains to your case.
