Almost every state requires most employers to carry some sort of workers’ compensation coverage, which protects employees who suffer injuries or occupational illnesses as a result of their job duties. However, the claims process can be complex, with multiple steps and strict deadlines that can make getting the benefits you deserve difficult. Understanding the process before filing a claim can help you avoid common mistakes that could cause your claim to be delayed or denied outright.

Filing a Workers’ Compensation Claim in Alabama

Determine Your Eligibility

workers compensationAlabama law requires every employer with more than five full- or part-time employees to provide protection against injuries and illnesses. However, there are a few exceptions. For instance, employers of domestic workers, some trucking companies, and agricultural companies are not required to carry coverage but may choose to anyway to prevent liability lawsuits.

Notify Your Employer

Your employer should be formally notified as soon as you experience an accident or receive a diagnosis for a work-related injury. In Alabama, injured workers have just five days to notify their employer, and you may lose your right to compensation completely if you fail to do so within 90 days.

Seek Medical Attention

If you’ve been seriously injured, you may seek medical attention at any emergency room, but tell the doctor that your condition is work related. In nonemergency situations, your employer’s insurance company may choose a doctor for you. In either case, be sure to follow all of your doctor’s recommendations, make appointments for referrals, and schedule a follow-up.

Speak to an Attorney

Unless your injuries were minimal and you recovered quickly, you should always speak with a workers’ compensation attorney before filing a claim. A legal professional will have been through the process many times and use their experience to advocate on your behalf. In addition to filling out the paperwork, your attorney will negotiate with insurers and represent you at any appeal hearings if your claim has been denied.
