Being accused of a DUI or OVI is a serious situation, with the potential to affect almost every area of your life. However, depending on the circumstances of your arrest, prosecutors may decide to file enhanced charges against you, sometimes known as an aggravated DUI. While Ohio law doesn’t have a separate charge for these aggravated factors, convicted drivers may still face much more severe penalties. No matter what charges you face, hiring a skilled DUI attorney is crucial for achieving the best possible outcome.

What Is an OVI?

dui attorneyIn Ohio, drivers with a blood alcohol content (BAC) of 0.08% or with trace amounts of illegal substances in their systems will be charged with operating a vehicle under the influence (OVI). Unless the defendant has previous OVI convictions on their records, a conviction will result in a minimum mandatory jail sentence of three days, along with alcohol or substance abuse treatment. In addition to paying a fine of at least $375, you will also have your driver’s license suspended for at least one year.

What Are the Penalties for a High-Tier OVI?

Drivers with BAC levels over 0.17%, who caused an accident in which someone was injured, or who have previous OVI convictions on their records will often face elevated charges. For instance, if you have been convicted of an OVI within 10 years, a conviction on new charges may result in a 30-day jail sentence, with fines of no less than $500. If you had minor children in the vehicle at the time of your arrest, you may face child endangerment charges in addition to the OVI offense, which may be a felony, depending on the circumstances. In these instances, a skilled DUI attorney will aggressively protect your rights, ensure you’re treated fairly, and negotiate with prosecutors on your behalf.
