If your Social Security disability claim was denied, you’re not alone. More than half of all initial applications are rejected. Unfortunately, that may not be enough to make you feel better if you’re struggling with a disability which prevents you from working. Depending on the circumstances, though, it may be possible to secure benefits by submitting an appeal or filing a new application.  Here are the advantages and disadvantages of both processes.

When to Appeal the Decision

You have 60 days to appeal an unfavorable decision from the date of receipt (usually 5 days from the date of the decision).  If you appeal the decision and end up securing benefits at the end of the process, you may be entitled to retroactive payments going back to your date of onset for SS disability benefits or to the initial application date for SSI only applications.  It is important to provide the SSA with all of your impairments and symptoms so that they have a clear understanding of how you are limited in your ability to work.  Securing representation to help with your application or appeal is usually the best course in order to ensure that your medical evidence is fully and fairly developed.

When to Reapply for BenefitsSocial Security disability

If your initial application was denied and you did not appeal the decision within 60 days, it is important to reapply for benefits as soon as possible in order to reserve the opportunity to reopen the prior application  for maximum payable benefits.  Retaining representation at the initial application level can help you to appeal the decisions in a timely manner to avoid losing out on benefits that you may be due.

It is always best to appeal an unfavorable decision if you are within the 60 day appeal period.  Many people make the mistake of filing a new application instead of appealing the denial which can delay the processing of the claim and receipt of the benefits that you have earned.
