Marriage is a legal arrangement, protected by the family laws of each state, which provides parties with rights and responsibilities toward the other. If your marriage is ending, the final divorce decree will reflect each party’s share of the marital property, describe any continuing financial obligations, and ensure your rights are protected. However, in some situations, you may be able to apply for an annulment, essentially declaring the entire marriage null and void.

What Is an Annulment?

family lawUnlike a divorce, an annulment completely cancels the marriage, negating all legal obligations the parties might have toward each other. For instance, after an annulment, neither party will have a right to the other’s property, with each of you just taking what you brought into the marriage. If you acquired joint assets during the marriage, you may need a family law judge to decide how those belongings should be divided.

When Can You File for an Annulment?

Annulments are granted in specific circumstances, which differ from state to state. Wisconsin, for example, will only grant an annulment if one party could not consent to the marriage, either because of age, a limited mental capacity, or being under the influence of alcohol or drugs. You may also pursue an annulment if either party is incapable of consummating the marriage, provided the other party did not know about the condition beforehand. If, for any other reason, the marriage itself violates state law, an annulment may be the best solution.
