5. Why shouldn’t I settle?: Sometimes you don’t have the option to settle, but at other times your lawyer may have very good reasons why it’s not beneficial to settle at this stage of the game.

6. What kinds of evidence will be shown?: Knowing this helps you get familiar with the strategies your lawyer will be taking in your case.

7. Who will you use as experts/witnesses?: Some trials will need the help of experts.

8. Are you using a trial consultant?: High-stakes litigation usually means hiring a professional that analyzes psychological or economic components as the trial is ongoing.

9. How much will it cost?: Consider estimates of the total cost and ask how the estimate could go up or down? Trials aren’t always predictable, and you’ll want to know why.

10. Who else will help with this case?: Some firms have their own litigation attorneys that will contribute to your case. Also, some firms bring in attorneys from other firms to fill a need when they require specific expertise.
