In a case with no permanent injuries, a claim is likely to settle several months after you have completed treatment and have recovered if you have an attorney who stays involved in your case. At Miraldi & Barrett, we contact our clients every several weeks while they are receiving medical treatment.  Because of this, we know immediately when our clients have completed treatment and we order records and reports.  This allows us to submit the claim to the insurance company as soon as possible.

When someone is more seriously injured, the time frame is longer because the medical treatment lasts longer.  Sometimes the doctor is unwilling to give a prognosis until more time has passed and the doctor has more information from which to base a prognosis.  This is particularly true when a serious fracture is involved.

When Miraldi & Barrett is involved, we will not settle your case prematurely because we know that a settlement is final.  We will not attempt to settle your case until a doctor has provided us with a prognosis that forecasts the future treatment or disabilities that stem from your injuries.

In some situations, a case cannot be settled without filing a lawsuit.  This is hard to predict.  Some insurance companies will not make a fair offer and will only offer a fair settlement after a lawsuit has been filed.  Other companies will make a prompt evaluation and want to resolve the claim and move on.
