Although employees in almost any industry can get hurt at work, construction workers are especially vulnerable to sustaining serious injuries on the job. Fortunately, as long as they work for a fully licensed and bonded contractor, they are entitled to workers’ compensation benefits. To file a successful claim, though, there are certain steps that injured employees must take after construction accidents.

What to Do After Getting Hurt at a Construction Site

1. Notify Your Employer

If you get hurt on a job site, notify the employer right away. Even if the foreman was present and witnessed the accident, you need to provide notice of your injuries and subsequent workers’ compensation claim in writing. If you fail to do so within 30 days, you may lose the chance to secure any benefits.

2. File a Claim With the Board

workers' compensationInjured parties must file the Employee Claim (C-3) with the New York State Workers’ Compensation Board as soon as possible. This form will prevent delays and interruptions in the claims process and benefits distribution. The fastest way to file is electronically. Although you technically have two years to pursue workers’ compensation benefits, the sooner you begin the proceedings, the sooner you can continue providing for your family while recovering.

3. Seek Medical Care

In the state of New York, injured workers can choose their own health care providers from a list of doctors who have been authorized by the Board. The employer’s insurance company should cover all related medical expenses regardless of who you choose from the list. However, some insurance companies have a preferred provider organization with additional stipulations, so talk to your employer before seeking care to ensure it is covered.
