Mr. Corletta won an outright dismissal of Driving While Intoxicated and Aggravated Driving While Intoxicated charges in a case that lasted some 4½ years in People v. L.M. (Gates Tn. Ct., 5/21/18). 

    Mr. Corletta's client was charged with Driving While Intoxicated and Aggravated Driving While Intoxicated involving a one car motor vehicle accident. In a bizarre string of events, which included a change in Town Justices, the first Town Justice failed to render a decision in a rather complicated Probable Cause Hearing, necessitating a second Hearing, before the new Town Justice, causing a delay of nearly 3 years. Mr. Corletta utilized this long and unjustified Court-caused delay to make a Due Process argument on behalf of his client resulting in a Speedy Trial Dismissal on Constitutional grounds, citing recent precedent from the State’s highest Court, as well as the United States Court of Appeals for the Second Circuit. 

    Marshalling 4½ years of facts into a concisely made motion and legal argument and applying the law, Mr. Corletta convinced the Town Justice his predecessor had unnecessarily delayed the case, resulting in outright dismissal and restoral of his client's driving privileges after a protracted period of time without it.

     The client, a military veteran who had been going through a very difficult personal time, and who faithfully made more than two dozen Court appearances, was extremely grateful for Mr. Corletta’s hard work and persistent advocacy.
