What Should I Do if I'm Hurt on the Job in New York?, Rochester, New York

If you sustain an injury at work in New York, your employer’s workers’ compensation insurance should cover all associated medical expenses. Seasoned attorneys will tell you that under workers’ compensation law, you should also receive a portion of your normal wages for as long as you are missing work to recover. To be eligible for these benefits, though, there are certain steps you must take immediately following the incident, including the following.

Finding an Approved Provider

In the state of New York, injured workers must receive care from an approved provider to qualify for medical benefits. To find an authorized healthcare provider, visit your state’s website or call 1-800-781-2362. If your primary care physician is registered with the NYS Workers’ Compensation Board, you may continue seeing them for treatment. If your employer’s insurer has a Preferred Provider Organization, they are required to notify you of this. If they fail to do so, workers’ comp attorneys can help resolve any issues that arise as a result.

Notifying Your Supervisor

attorneysInjured workers must report the incident in writing to their employer within 30 days. A workers’ compensation law attorney can help you draft this letter and ensure it contains all essential details. You must also file a Form C-3, Employee’s Claim for Compensation, as soon as possible. There are three ways to do so: online, on paper and then via mail, or over the phone by calling 1-877-632-4996. If your case requires a hearing, the board will then notify you via mail.
