On January 1, 2018, the Department of Transportation (DOT) adopted new changes to 49 CFR Part 40 regulations, instituting important changes to federal drug testing requirements. These modified regulations impact every American employer subject to DOT regulation, including small businesses and self-employed drivers. These new regulations are intended to align the DOT drug panel with the standards set by the Department of Health and Human Services. These new modifications reflect changes in the availability of certain substances and new changes affecting the safety of American Roads.

Substances Added to DOT Drug Testing Panels

Due to the growing popularity of semi-synthetic substances, the amended regulations mandate that all DOT-regulated programs expand the number of Schedule II substances included in panels. Drug tests will now screen for hydrocodone, hydromorphone, oxycodone, and oxymorphone, as well as methylenedioxyamphetamine (MDA), a type of amphetamine. Methylenedioxyethylamphetamine (MDEA), however, has been removed from the initial screening.

Changes in Terminology

drug testingBecause many substances available are at least partially synthetic, the new regulations include terminology changes to ensure these drugs are included. The word “opiates” is replaced with “opiods,” since hydrocodone, hydromorphone, oxycodone, and oxymorphone are not actually derived from the opium plant, although they produce similar effects.
