Parental Obligations

Both parents have an obligation to support their children. Generally, the parent who has physical custody of the child more than half of the time—the custodial parent—provides direct support for their children. The non-custodial parent who spends less time with the child pays support.

The state guidelines for child support take into consideration each parent’s gross and net income and their status as a custodial or non-custodial parent. Gross income includes wages, salary, and commissions from all jobs, and other income such as dividends or pension payments. To obtain a net income figure, subtract items such as pre-existing child and spousal support, income taxes, and Social Security from the gross income amount.

Adjustments to Support Amounts

The courts use a guidelines worksheet and child support calculator to figure the amount of child support a non-custodial parent must pay. Before imposing an order of support, courts may make adjustments up or down based on parental circumstances and special needs of the children, such as physical disabilities or special educational requirements. Once a child support order is in place, a parent can seek modification by the court or the Child Support Enforcement Agency (CSEA) if circumstances change.
