Brower Law Corporation in Honolulu, HI, their attorneys take sexual harassment claims seriously. Here, they discuss how anyone, regardless of their gender, can be a victim of sexual harassment and workplace discrimination.

What Is Sexual Harassment?

The Equal Employment Opportunity Commission (EEOC) definition of sexual harassment includes verbal or physical harassment of a sexual nature, such as unwelcome sexual advances and requests for sexual favors. It also includes other conduct that explicitly or implicitly affects an individual’s employment, unreasonably interferes with their work performance, or creates an intimidating, hostile, or offensive work environment. The person being harassed and the harasser can be male or female.

Can Men Be Victims of Harassment?

sexual harassmentIn the 1998 case, Oncale v. Sundowner Offshore Services, the United States Supreme Court ruled that sexual harassment by one man against another man is discrimination according to Title VII of the Civil Rights Act of 1964. In this case, the victim was a male oil rig worker who alleged his male manager sexually harassed him while they worked on assignment in the Gulf of Mexico.

In February of 2017, EEOC sued Hidden Hawaii Tours, alleging the company’s president engaged in a 10-year pattern of sexual harassment against his young male employees. The behavior included displaying pornographic images to employees and performing sexual acts with them. When the workers complained to the company, the company did nothing.
