State Requirements

Every state has its own statutory system for identifying sex offenders. In New York, under the Corrections Law, individuals who are “convicted” of certain specified offenses must register with the State Division of Criminal Justice Services. Youthful offender adjudications do not count. However, a prior “Y.O.” can be used in adding “risk assessment points” if you are subsequently convicted of a sex crime as an adult. 

Points are assessed using a “Risk Assessment Instrument” and the Court, after a hearing, determines whether you are a low risk (Level 1) or a medium or high risk (Levels 2 or 3) to re-offend. The period of time you must register (minimum 20 years), and the degree of community notification is determined by the risk assessment level.
