Like all states, Ohio forbids anyone under the age of 21 to purchase or consume alcoholic beverages. Any violation of this law is considered a serious offense—and even more so if the underage offender operates a vehicle under the influence. As a DUI attorney who has been serving the Cincinnati, OH, area for more than a decade,  James F. Bogen, Attorney at Law, answers three common questions about underage drinking charges.

FAQs About Underage Drinking Charges

1. Many College Students Drink; Are the Laws Really That Strict?

DUI attorneyIn Ohio, underage drinking is a first-degree misdemeanor charge, and while law enforcement can't conceivably crack down on every single case, they still aim to enforce the law whenever possible. Also, most college campuses have their own police units, who have an increased presence at events where the crime is more likely to take place, such as sporting events.

2. What Are the Penalties for Underage Drinking?

There are several different charges: underage alcohol consumption, possession, and intoxication are just a few. What you’re ultimately charged with will largely depend on the circumstances surrounding your arrest, who was with you, where you were at the time, and how you behaved around law enforcement. Possible penalties include a fine of up to $1,000, up to six months in jail, and community service or probation.

3. Are DUI Laws Different for Underage Drivers?

There is even less tolerance for drinking and driving when the offender is underage. A blood alcohol content of .02 or higher is an automatic DUI charge. You could be fined at least $250, face a jail term of up to a month, and have your license suspended for 90 days. Never take a drunk driving charge lightly; speak with a DUI attorney who can help you explore your legal options.
