It is essential to bear in mind that social security and workers' compensation benefits are always mandatory. Your employer must provide them—that in itself gives you the right to pursue action, whatever the outcome of your case.

What do you do when you're injured on the job? Getting medical treatment as soon as possible is critical, both personally and legally. It's also important to note that the health care provider treating you needs to be authorized by the Workers' Compensation Board, except in the case of an emergency. 

You must contact your supervisor immediately. This is especially important because if your employer is not contacted—in writing—within 30 days of being injured, you could lose the right to pursue your case. Technically, you have two years to file a claim, but those with bodily injuries are not going to want to wait that long; such stipulations apply mostly to those who've contracted occupational diseases while on the job and who often don't realize they've become ill until later.

In any event, however, you need to prove that your condition occurred as a result of being in the workplace. Be sure to follow all your doctor's instructions, as not doing so could compromise your claim. Keep copies of all medical records as well.
