Most civil litigation never goes to trial, usually being resolved with a settlement or mediation. But when these methods don't work, and when a claim is not dismissed outright, there will be a trial. Your personal injury lawyer will help you prepare for your court date, but first, Arndt Buswell & Thorn S.C. in Sparta, WI, recommends understanding the basic outline of a civil trial.

What to Expect in Court

Jury Selection

personal injury lawyerNot all civil cases include a jury; your case may simply be heard by a judge if the parties involved don't request a trial by jury. Assuming a jury is involved, the judge, your opponent's lawyer and your personal injury lawyer will interview the potential jurors to find those who will serve in your case.

Opening Statements

This is an outline of the cases your lawyer and the opposing lawyer intend to make during the trial. The plaintiff will attempt to prove the defendant's liability in the case, and the defendant will attempt to disprove it. The opening statements tell the judge and jury how the lawyers plan to argue their cases.

Presentation of Evidence

This can include witnesses who will be questioned and cross-examined as well as physical evidence such as documents and photos. The plaintiff is the first to introduce witnesses and evidence, the defendant second.

Closing Arguments

Like the opening statements, these condense the arguments of each side. This is the last chance for either side to address the jury.

Jury Instruction, Deliberation and Verdict

The jury is given guidelines regarding the legal standards that determine liability. They are then given time to discuss the case, and once a consensus is reached, they deliver their conclusion. If no jury is involved, the judge will hand down a verdict.

A trial has strict rules, but the general process is still fairly simple.
