Sex Crimes Defense: Sexual Abuse Law & Punishments, Dothan, Alabama

Lawyers defending individuals accused of committing sex crimes must overcome hurdles that did not exist two or three decades ago. Changes in the law regarding sexual assault allegations can challenge even the best criminal defense attorneys. Here is where Alabama stands on the law, punishment, and defense of sex crimes.

Sex Crimes, Punishments, & Defenses in Alabama

First Degree Sexual Abuse

Individuals who force others to engage in or submit to any physical contact that is sexual by nature will face felony charges of sexual abuse in the first degree. These sex crimes, which include rape, forced oral sex, and unwanted fondling, carry punishments of prison terms up to 10 years long and fines as high as $15,000.

Second Degree Sexual Abusesex crimes

When the victim of a sex crime is between 12 and 16 years old, and the accused is at least 19 years old, the crime is charged as a second degree offense, which is a class A misdemeanor. These sexual offenses carry a maximum of one year in jail, with fines up to $6,000. In addition to criminal charges, accused individuals may face personal injury lawsuits.

Defending Sex Crimes

Criminal defense attorneys cannot use an accuser’s past sexual history to prove consensual sex. Rape shield laws protect victims from such legal defense tactics. However, consent between the parties remains an effective defense for skilled criminal lawyers. Another defense is showing that the accuser had a motive to tell a lie. Such motives include attempting to gain an advantage in a divorce or child custody dispute, to obtain money from the accused, or to protect their own reputation.
