What Is an Ignition Interlock Device? A Local DUI Attorney Explains, Lexington-Fayette Central, Kentucky

Drivers convicted of a DUI usually have their driving privileges suspended or revoked as part of their sentence. Kentucky law allows convicted drivers to install an ignition interlock device on their vehicles so they can continue to drive to work and care for their families. To educate the public about this option, a DUI attorney at Anggelis & Gordon, PLLC in Lexington, KY, explains what the device is and how it works.

A DUI Attorney Discusses Ignition Interlock Devices

What Is an Ignition Interlock Device?

Like a Breathalyzer™, an ignition interlock device is a piece of equipment that uses a breath sample from a driver to gauge the amount of alcohol in the driver’s system. The device is set with a predetermined test level, and if the driver’s breath registers above that level, the device locks the car’s ignition.

How the Test Works

DUI attorneyThe driver blows into the device mouthpiece, and if the breath sample is under the preset limit, the device allows the car to start. If the device detects alcohol, the car does not start and the driver must wait a few minutes to give another sample. If alcohol is detected again, the wait is even longer. Each time the driver fails the test, the wait time increases.

To start the process of obtaining an ignition interlock in Kentucky, drivers apply to the court where they were convicted of the DUI. The court then decides whether to issue an order permitting the driver to obtain the device.
