Mr. Corletta saved his self-employed, tradesman client’s ability to operate their business in People v. C.S. (Brighton Tn. Ct., 11/30/16)

In that case, the client, who is a tradesman who owns a business, was charged with Felony DWI.

          Facing immediate license suspension at arraignment, Mr. Corletta convinced the Court to give his self-employed client a Hardship License in order to drive to multiple job sites over the next 30 days; when a Hardship License ordinarily applies to those who work at a fixed location. Mr. Corletta argued the client had multiple work locations and should be able to drive to multiple work sites, citing a recent DMV ruling.

          Although not an argument normally accepted by courts, Mr. Corletta had his client assemble a calendar showing all the job sites the client would service over the next 30 days. The Court, impressed by this detailed showing, granted his client a broad license to drive to all job locations, something generally unheard of.

          As a result, Mr. Corletta got his client's business out of danger, and preserved his client's ability to earn a living.

          This was extremely unusual given the seriousness of a Felony Driving While Intoxicated charge.

          This demonstrated Mr. Corletta's knowledge of the law, diligence, and preparation; as the Court immediately agreed with Mr. Corletta's analysis and granted his client a Hardship License with broad privileges. Sometimes, not all victories are big victories. Mr. Corletta counsels his DWI clients that each stage of the case must be addressed individually and separately from the other, without looking too far ahead. Looking too far ahead makes the task seem more daunting. Approaching it step-by-step makes it appear more manageable.
