People v. W.D. (Monroe Co. Ct., 9/14/16)

            Mr. Corletta recorded his 20th consecutive reduction, dismissal, or acquittal, in a contested matter in People v. W.D. (Monroe Co. Ct., 9/14/16). In that case, which involved a Felony Indictment for Driving While Intoxicated, Mr. Corletta attempted to obtain a Misdemeanor reduction for his 56 year old client, who had only one prior conviction and was steadily employed in the same job for well over 20 years.

            The District Attorney, taking an unnecessarily harsh position, refused, and indicted Mr. Corletta’s client.

            Mr. Corletta vigorously opposed the Indictment promptly, filing Pre-Trial Motions, requesting inspection of the Grand Jury Minutes, and further requesting and granted appropriate Pre-Trial Hearings.

            In the meantime, the District Attorney was dilatory in turning over the Grand Jury Minutes to the Court. Watching this carefully, Mr. Corletta waited until too much time had run, and then brought the appropriate Speedy Trial Motion, citing applicable caselaw, which was largely uncontroverted by the People. The Court granted the Motion and his client's license was restored, and the cloud of a completely unnecessary Felony Indictment removed. 

            Needless to say, the client, who had only a minor prior criminal record, was gratified their driving privileges were restored and the Indictment dismissed.
