  • How does the court decide? The court will review all provided information and make a decision based on what is best for the child. This includes the stability of the home, the fitness of each parent, and how well the parents cooperate. The court will also take into account who the primary caregiver has been in the past and will work to keep siblings together. Children who are 12 and older will have their preferences considered in the decision.
  • Where do we go from here? Once the custody and visitation schedule is in place, then it can be modified only by an agreement between both parties. If there has been a change in circumstances, or if the older child expresses a wish for a change, parents can request a modification. If the parents cannot agree, the court will decide, either via trial or mediation.
