Like every state in the union, Georgia has strict DUI laws that aim to protect the rights and safety of all drivers on the road. If you've been arrested for drinking while under the influence, it is crucial that you understand the charges against you and the repercussions you could potentially face. To help you do this, below is a brief overview of the state’s rules.

The Laws & Consequences for a DUI in Georgia

1. First Offense

A first-time DUI comes with the possibility of fines and incarceration. A fine will be anywhere from $300 to $1,000, and you could be sentenced to as much as one year in jail. There is also a mandatory minimum community service commitment of 40 hours, and you could lose your license for up to a year.

2. Second Offense

DUIIf you receive a second DUI within five years of your first one, harsher penalties are instituted. You will spend at least 48 hours in jail, and you could be given up to a year if you're found guilty. Your fine is raised to a minimum of $600, with a maximum of $1,000. Your driver's license will be revoked for three years, and you will have to perform 30 days of community service. You will also have to undergo a psychological evaluation to determine if you need substance abuse counseling; if you do, you must complete treatment at your own expense.

3. Third Offense

A third DUI offense within five years of your second brings a minimum of 15 days in jail and a fine of at least $1,000, though you may be charged up to $5,000 depending on the judgment against you. You lose your license for five years. There is a mandatory minimum of at least 30 days of community service, and you will be required to pay for substance abuse treatment if the courts find you need it. Also, your name, address, and photograph will be published—at your expense—in the local newspaper as a public service warning.
