The state of Pennsylvania issues an Ignition Interlock Limited License (IILL), which allows certain individuals convicted of drunk driving to operate a motor vehicle while their license is revoked or suspended. An Ignition Interlock Limited License has specific rules and guidelines, which can be confusing for people who are dealing with the matter for the first time. Below, the DUI attorneys at Bitar & Bitar, LLP, in New Kensington discuss some basics of the IILL.

DUI Attorneys Explain Who Qualifies

Not everyone with a DUI will meet the eligibility requirements for an IILL. Three types of people usually qualify:

  • Those with no prior DUI offenses can apply for an IILL immediately.
  • Individuals convicted of an ungraded misdemeanor must wait until six months of their license suspension have passed before they can apply.
  • Anyone convicted of a first-degree misdemeanor must wait until nine months of their license suspension have passed before applying.

DUI attorneyTo obtain an IILL, you must first have an approved ignition interlock device installed in your vehicle, as well as car insurance. Next, you’ll fill out an application with the Pennsylvania Department of Transportation and provide them with proof that you have the proper device installed and coverage for your automobile.

Exceptions to IILL Rules

There are a few noteworthy exceptions to the standard IILL rules and guidelines. If you have an IILL for your personal vehicle but also drive a business car owned by your employer, you do not need any special permission to continue using your business car for work purposes; your employer, however, will need to complete and submit a notarized form stating that they are aware of your situation. Also, unlike previous IILL laws, you only need the interlock system on the cars you drive, not necessarily on all the ones you own under your name.
