In the state of Nebraska, there are many laws that help protect nursing home residents from neglect or mistreatment. For instance, Nebraska Department of Health and Human Services (DHHS) stipulates several requirements regarding business licensure and facility grounds. These nursing home regulations help promote a quality standard of care, as well as provide a pathway to legal action in the case of a violation.

5 Nursing Home Regulations

1. Bed Use

Nursing home facilities cannot use more beds than their license allows. Likewise, they may not allocate more residents to a bedroom than the legally mandated capacity permits. If a facility wishes to include more beds, then it must pay fees for additional licensure.

2. Resident Deaths

If a resident dies due to a violent act or suicide, the facility must notify the DHHS within 24 hours. Likewise, if the resident dies due to staff abuse or neglect or because the resident left the facility without staff knowledge, a notification within 24 hours is also necessary.

3. Public Information

Nursing homes must make a variety of information available upon public request. This information may include licenses, record information, and inspection reports.

4. Change of Ownership

5. Nature Disasters & Emergency

A nursing home facility must notify the DHHS within 24 hours of a fire department visit, natural disaster, or any other scenario that had an adverse effect on the health, safety, or overall well-being of residents. The notification must include a detailed description of events, as well as precisely what measures were taken to improve the quality of care and safety during the time.
