DUI, which stands for driving under the influence, is one of the most commonly used terms for charges related to drinking and driving. Other oft-used acronyms include DWI (driving while intoxicated) and OVI (operating a vehicle impaired). Although some states use these terms to differentiate between various offenses, a DUI, DWI, and OVI arrest are typically interchangeable in Ohio.

Understanding a DUI & an OVI Arrest

The Various Acronyms

In the state of Ohio, it is illegal to operate a vehicle while impaired by drugs or alcohol. If you do so and police conduct a traffic stop because they notice signs of drunk driving, an OVI arrest can result. Other terms you might hear in place of OVI during the arrest or any subsequent proceedings include driving under the influence of intoxicants (DUII), driving while ability impaired (DWAI), driving while under the influence (DWUI), operating under the influence (OUI), and operating while intoxicated (OWI).

In the early 1980s, Ohio statutes referred to drunk driving as operating a motor vehicle impaired, or OMVI. Today, the statutes have since been amended to state the vehicle does not need to be motorized for an individual to face charges. Thus, the acronym was shortened to OVI, which is what you can expect to hear from most police officers and prosecutors today. Regardless of the term or acronym law enforcement officials use to describe the charges you are up against, you could face severe penalties, even if it is your first offense.

The Various Penalties

ovi arrestThere are both administrative and criminal penalties for OVI in Ohio. When it comes to administrative penalties, first-time offenders can face a 90-day license suspension, which is independent of any criminal license suspension they receive, and the installation of an ignition interlock device. Additional criminal penalties include up to six months in jail, a fine of up to $1,075, and a license suspension of up to three years.
