When you are required to file a federal tax return and you don’t file the IRS can file for you. It’s called a substitute for return.  The IRS has your earnings records for each year and will use this information to file you a federal income tax return. This return will often have a filing status that results in the highest balance due for the taxpayer.  While the IRS has your earnings records it doesn’t have and won’t use your tax deductions and any dependents in this tax calculation. So you likely will owe them money and in many instances lots of money.

The good news is that this can be fixed by filing an original return and sending this return to the correct department of the IRS for processing.  This original return should include all your deductions and dependents.  This will reduce or eliminate your IRS balance due when you file an accurate federal tax return. You can even have a refund.

If you don’t have your income records (W-2, 1099s etc.) we can prepare a valid power of attorney and get those documents from the IRS. If you have no records for your deductions we can make a reasonable estimate of those with proper disclosure to the IRS when the returns are filed.  We have represented many taxpayers who fell behind on their tax filings and relieved them of this tax problem.
