In Connecticut, drunk driving is called OUI, or “operating under the influence.” If you’re facing a charge of driving while intoxicated, your best option is to have someone on your side who knows the law. DUI lawWhile the state has set limits on the blood alcohol concentration (BAC) which qualifies a person as legally intoxicated, you can still be prosecuted for an OUI charge even if you haven’t been administered a BAC test. Under Connecticut OUI law, it doesn’t matter how much you’ve had to drink; if your ability to drive is impaired, you’re breaking the law.

Once arrested, you’ll be administered a BAC test. You can refuse to take this test, but refusal has its own legal penalties which are greater than the standard consequences for testing above the legal threshold for intoxication.

After you have been arrested for operating under the influence and have either taken or refused a BAC test, the record of your arrest will be sent to the Department of Motor Vehicles (DMV). The current DUI laws in Connecticut allow for the DMV to penalize you with a license suspension before you even go to court—they also allow the DMV to require that you use an ignition interlock device, or IID, for some time afterward. The length of time is based on a few different factors, including your motor vehicle record.  If these charges result in a conviction, the court will extend these penalties. If you are convicted three or more times for an OUI charge, you may permanently lose your license.
