If the deceased person left a will, that document would name a person to serve as the executor. If there is no will, the probate court appoints an administrator to serve in this position. This person is in charge of gathering the dead person’s assets, paying their debts and taxes, and ultimately distributing any remaining assets to the surviving heirs and beneficiaries. The probate judge and their staff will then assist the executor or administrator with these tasks.

2. Executor Files Proceedings In Probate Court

The probate judge determines whether or not the deceased person’s will is valid or, if there is no will, the probate judge would then decide which heirs would inherit the estate. Once these decisions are final, any property that remains after all debts and taxes are paid can be converted to the beneficiaries. For example, the title to a home can be reassigned to the new owner.  

3. The Executor Finalizes All Other Probate Business

Not all property is handled during the probate process. Non-probate property includes property that is co-owned with another person or accounts or items that are payable on death. Typical examples include bank accounts and homes owned by two spouses. Other examples of non-probate property could include insurance policies, bonds, or retirement benefits. These assets are typically dealt with outside of the probate proceedings.
